Personal Injury Law

Personal injuries often cause financial hardship through loss of work, medical bills and stress placed upon families and loved ones, and emotional hardship because of long-lasting or permanent pain and suffering caused by a serious personal injury.

Pedestrian Accidents

Pedestrians are extremely vulnerable to being hit by cars in most busy cities.  When a pedestrian accident happens, the pedestrian may have the right to be compensated by the motorist.  In many cases, pedestrian accidents can be life threatening because of a motorist’s irresponsibility.  When driver’s aren’t careful, and hit pedestrians, they can cause extremely serious injures/fatal injuries.

Common Causes of Pedestrian Accidents

Pedestrian accidents normally occur in residential/densely populated neighborhoods where drivers don’t take caution.

     * Speeding: This is one of the leading causes of pedestrian accidents in Nevada.   Excessive speeding is a major hazard on pedestrian streets.  When drivers speed, and are busy texting/on the phone, this is a recipe for a fatal and life altering injury.

* Ignoring stop signs: Reno is full of interactions where drivers, in a fit of frustration, are in a rush, and ignore stop signs. These stop signs are in place to help protect pedestrians, and when drivers disregard basic safety issues – this can lead to fatal pedestrian accidents.

Ignoring surroundings: In dense cities or highly-congested traffic areas, if you’re not careful you might miss important details while driving – like children in the vicinity, especially if they aren’t under the direct supervision of adults.  In many cases, careless drivers cause accidents when they ignore their surroundings and don’t see children in the area.

Premise Accidents

People have a reasonable expectation of safety when they visit a business or residence, because facility owners have a responsibility to maintain their property in a safe condition.  However, sometimes accidents happen and a person can be injured or killed due to unforeseeable circumstances.

Maybe you or someone you love stumbles in a warehouse, trips in vacant lot, or slips and falls at a marina, where someone else’s negligence in observing safety standards has put you at risk.  If the accident was indeed related to the property owner’s negligence in maintaining the property in a safe manner, you may have grounds to file a premises liability lawsuit.

While property owners are responsible for keeping their facilities free of hazards, some types of hazards are inevitable. For example, weather can create significant risks due to high water, ice, fallen tree branches, and acts of Mother Nature.  A property owner has a responsibility to remove these hazards or, at a minimum, to put up a clear warning for guests to stay away from the danger.

No matter how obvious fault may appear to those untrained in the law, the issues of premises liability are complicated and sometimes overlapping.  Government agencies have established standards, laws, and ordinances to define levels of safety that property owners must meet. Determining which of these standards, laws, or ordinances applies to a particular case is the job of attorneys experienced in sorting them out and identifying legal responsibility.

Consumers hurt due to the negligence of a manufacturer may be entitled to financial compensation.  Often, in many cases, companies are negligent in the production or manufacturing of products.  Product manufacturers and anyone in the chain of commerce can be held liable for harm caused by a negligently designed, manufactured, of inadequately warned product.  Nevada law holds that negligent manufacturers, sellers, re-sellers, re-manufacturers and dealers can all be forced to pay for a defective or dangerous product that caused injury to a consumer.
